What do I need to send to NCSLA to file NC Surplus Lines Tax?+

REQUIRED FORMS FOR EACH TAX FILING

  1. Countersignature Form
  2. Copy of Completed Form F
  3. Declarations Sheet or Binder of the policy showing the premium (do not send entire policy)
  4. Copy of Non-Resident NC Surplus Lines Brokers LicenseCheck or checks that include the tax amount and the NCSLA filing fee
  5. Please include the name of a contact person from your agency with phone number and email address

If you are missing any one of these items, do not mail the filing in as we are unable to file with the NCDOI.

How do you process Subscription / Multiple company policies?+

The NCDOI requires that the NCSLA file taxes separately for each insurance company that participates on this type of policy. A separate filing must be made for each participant with the specific premium that is allocated to that insurance company. A policy fee ($110) will apply separately to each participant on these filings. This process will also apply to each endorsement on these policies.

Lloyds – 25% Premium $500 Tax plus filing fee on each policy
Lexington – 50% Premium $1000 Tax plus filing fee on each policy
Essex – 25% Premium $500 Tax plus filing fee on each policy

What do I need to send in for an endorsement or cancellation?+
  1. Countersignature Form – (Required)
  2. Copy of the Endorsement (including amount of additional or return premium)
  3. Agency name, address, contact person with email address
  4. Check for filing fee + tax amount if it is an additional premium endorsement or audit


No fee on premium reduction endorsements or cancellations.


Please note that all fees are fully earned and there is no return of any fees even on Flat
Cancellations.


Note: The NCSLA does not accept email filings at this time – all filings must be mailed
into the NCSLA for processing.

Do Non-Resident licensees need to send anything to the NCSLA if they have not written any business during the year?+

No, you do not send anything to NCSLA unless you are writing new business or filing tax on endorsements with returns, additional premiums, or cancellations.

What is the time period for filing tax?+

30 Days, however, NCDOI is usually lenient for up to 90 days.

Is there a penalty for late filings?+

Yes, any policy that is filed after it has expired will be subject to a penalty imposed by the North Carolina Department of Insurance.

There is also an additional $25.00 filing fee on each late policy being filed due to the additional procedures that are involved with a “Late” Policy.

Do not figure or pay a late fine, the NCSLA will notify you as to the amount of the penalty, fee and when the NCDOI must receive this penalty.

Is the North Carolina filing fee fully earned?+

Yes, even on flat cancellations.

The tax will be returned on cancellations and premium reduction endorsements, but filing fee is fully earned in all cases.

Do I need to send a copy of the application?+

No. Effective 12/01/2013, we no longer require the application.

What are the NCSLA filing fees?+

$110.00 for each New & Renewal Filing.
$50.00 for any additional premium endorsement.
$25.00 for each policy that is filed late. (Determination of the NCDOI)

How do I pay the NC Surplus Lines tax and filing fees for 2016 business?+

Both of the checks for the NC Surplus Lines tax and the NCSLA filing fees on 2016 policies must be mailed directly to the NCSLA office location.

When will I receive the NC taxes for cancellations or premium reduction endorsements?+

Checks will be issued after each quarterly reporting period at the latest.

Note: We will not hold returns to offset future filings, as we have no system to account for them

Is it permissible to write one check for multiple filings? (Over 3)+

Yes, as long as you send a reconciliation list that breaks down the taxes and fees for each policy that is included in the check. Otherwise we will require a separate check for each & every filing.

NC Surplus Lines Tax on Policy Fees+

A. Broker fees are not taxable
B. Company (Insurer) fees are considered premium and are taxable
C. NCSLA filing fees are not taxable

What if I am unable to get a NC Form F signed?+

This form is required by North Carolina Insurance Statute 58-21 – If you do not receive, you should cancel the policy immediately. We are unable to file without a fully completed Form F. Do not submit a filing without the Form F. Any exception to this Statue can only be made by the NCDOI.
